Social media competition rules


I. General provisions

  1. These rules (hereinafter referred to as “Rules”) govern online competitions (hereinafter referred to as “Competition”) organised by the organiser (hereinafter referred to as “Organiser”).
  2. The Contests are not consumer or other lotteries, and do not have the element of making a deposit, purchasing goods, entering into a contract or participating in a promotional event as a condition of participation in the contest.
  3. Participation in the competitions is voluntary.

II. Competition organizer

  1. The competition is organized by Faster CZ spol. s r.o., with registered office at Jarní 1064/44g, 614 00 Brno, ID: 60722266, VAT: CZ60722266, registered in the Commercial Register maintained by the Regional Court in Brno, Section C, Insert 16631.
  2. The competition is not created, administered or sponsored by the social networks Facebook or LinkedIn.

III. Time and place of competition

  1. The competition takes place on the organiser’s social networks Facebook and LinkedIn www.facebook.com/Fastercz/ and www.linkedin.com/company/faster-cz/ or via the newsletter sent via the Listmonk app (hereinafter referred to as “networks”).
  2. The date of the competition, the assignment and the detailed rules are always included in the specific competition post on the networks, where the organiser informs the participants about the ongoing competition.
  3. The organiser is entitled to extend or shorten the competition dates. The organizer reserves the right to change the rules of the competition at any time or to cancel the competition completely without giving reasons. Any change or modification will always be made in writing on the organizer’s networks.

IV. Terms of participation

  1. The competition is open to natural persons with permanent residence in the Czech Republic over 18 years of age, younger only with the consent of a legal guardian (hereinafter referred to as the “Participant”), who are registered on Facebook or LinkedIn. The organizer has the right to verify the identity of the participant or the winner for the purpose of evaluating the competition in accordance with these rules.
  2. The Participant is obliged to have an authentic profile active on the network in question for the entire period of his/her participation in the competition, which is not blocked, meets the conditions of the network and follows the competition profile throughout the competition period until the competition is evaluated. An entrant is not eligible to enter the competition through multiple profiles on the same network.
  3. Persons in a working or similar relationship with the organiser or with the persons responsible for organising the competition (technical administrator, agency, etc.) and persons who are in a close relationship with such persons are excluded from the competition.
  4. Each participant may enter as many answers as he/she wishes. However, they may only win once in a given competition.
  5. A participant who enters an entry that is incompatible with applicable Czech legislation or other standards, harms the legitimate interests of the organiser or is contrary to good morals will not be entered into the competition or may be excluded from the competition. The assessment of the compatibility of the entered activity with the rules is the sole responsibility of the organiser, who is entitled to exclude any participant from the competition. In this way, the winner may also be excluded from participation in the competition.

V. Competition and prize mechanics

  1. A post will always be published on the organiser’s networks with the competition brief, which will include the date of the competition, the number and type of prizes and the competition task. The competition is governed by the rules contained in the competition brief and these general rules.
  2. Only as many entrants as the number of prizes specified for each competition may win in each competition.
  3. By participating in the competition (by posting a comment, photo, hashtag, emailing or otherwise posting a competition answer), the participant agrees to the rules and agrees to abide by the terms and conditions of the competition.
  4. It is not possible to change or modify the contest answers once registered. This modification of the competition answer is considered a new competition answer and thus a repeated participation in the competition. In this case, the participant may be disqualified.
  5. The winner will be one or more entrants who are specified by the rules contained in the competition brief in the competition entry.
  6. The prizes in the relevant competition will always be disclosed within the competition entry.
  7. Prizes are non-transferable and never consist of real money.
  8. Winners will be notified of the exact date and method of delivery of prizes via direct message on the networks.
  9. Prizes are not legally entitled to, and cannot be exchanged for cash or claimed in lieu of, any other consideration. Prizes are not enforceable in court.

VI. Notification of winners and prize handover

  1. The winner will be contacted by the competition organiser within 7 days of the end of the competition via a comment under the competition entry or by private message from the organiser’s network to complete any relevant additional information (name, surname, email, address for delivery of the prize).
  2. If the date and method of delivery of the prize is not agreed with the winner within 14 days of contact or the winner fails to claim the prize in accordance with the organiser’s instructions, the winner’s right to claim the prize will be terminated and the prize will be forfeited to the organiser, who may decide to award it to the next participant in the ranking or dispose of it in another way.
  3. Prizes are delivered only to valid and properly marked addresses in the Czech Republic via the postal and delivery service provider chosen by the organiser.
  4. The prize is delivered only once, no alternative delivery is possible.

VII. Personal data processing

  1. The personal data controller is the organiser.
  2. The contact details of the data controller are listed here.
  3. The participant gives his/her unreserved and voluntary consent to the organizer to process personal data.
  4. The purpose of the processing is the implementation of the competition, organization, management, evaluation, control and delivery of prizes.
  5. The legal basis for the processing is the participant’s consent, which he or she voluntarily gives by entering the competition as a marketing event. The participant may withdraw his/her consent at any time. The processing of the entrant’s personal data is necessary for the purpose of the competition and the withdrawal of consent ends the participation in the competition.
  6. The period of processing of personal data is the period of the competition until the prizes are handed over and 6 months thereafter for control purposes. After this period, only a limited amount of data is retained for the fulfilment of the legal obligations of the organiser and in the event of an inspection by a supervisory authority.
  7. The participants expressly agree that the organiser is entitled to use the following data in accordance with Sections 77 et seq. of Act No. 89/2012 Coll, Civil Code, as amended, free of charge to the participants the first name and the city in the media (including the internet), promotional and advertising materials of the organizer in connection with this contest and its products or services, with the proviso that audio and visual recordings of the participants (in particular of the winner in connection with the drawing of the prize) may be made and published in the above-mentioned manner for a period expiring 5 years from the end of the contest.
  8. If the winning entry is a work protected by copyright law, by entering the competition the winner confirms that he/she is the author of the entry and/or has all necessary copyrights to it and grants consent to its use, i.e. a free, time and territory unlimited license.

VIII. Concluding provisions

  1. The organizer is not responsible for any technical problems related to participation in the competition (especially the functionality of social networks).
  2. The organiser is not responsible for any defects in the prizes, for any damage caused by them or for any loss of prizes during transport.
  3. Participation in the competition cannot be enforced by legal action.
  4. Otherwise, the competition and the relations between the participant and the organiser are governed by the law of the Czech Republic.
